What About The Costs of a Personal Injury Lawyer?

Many people encounter it, a lawyer. For example, because you are being fired or your salary has not been paid for 3 months. Or when dividing the contents in the event of a divorce. A lawyer will then help you with legal matters so that you can get on with your life.

Unfortunately, lawyers are expensive; an hourly rate of € 200.00 or more is very common in the legal profession. However, there are exceptions. For example, in the Netherlands you can use the services of a personal injury lawyer in The Hague (Dutch: letselschade advocaat Den Haag) free of charge if you have been hit by a car in this city. But how does this work and what about the costs of a personal injury lawyer in other European countries?

Free legal assistance from a personal injury lawyer in the Netherlands

Free legal help from a personal injury lawyer in Eindhoven  (letselschade advocaat Eindhoven) or another Dutch city. This of course sounds like nonsense; how can you use a lawyer free of charge?

In the Netherlands, the right to legal assistance in personal injury cases is regulated by law in Article 6:96 of the Civil Code. The 2nd paragraph of this article of law reads:

“Financial damage is also eligible for compensation.

  1. the reasonable costs to prevent or limit damage that could be expected as a result of the event on which the liability is based.
  2. reasonable costs to determine damage and liability.

c.reasonable costs to obtain payment out of court.

In other words, if you are the victim of a bicycle accident, a car accident or have been bitten by the neighbor’s dog, you can claim personal injury compensation under Dutch law, but also reimbursement of the costs of a personal injury lawyer. 


Downside of the Dutch system

Unfortunately, the Dutch system also has a downside. Because every victim of an accident can claim the help of a personal injury lawyer free of charge, there are also many lawyers and even non-lawyers who offer to recover personal injury damages.

The law does not talk about a free personal injury lawyer, but about the costs that must be reimbursed. Anyone can call themselves a personal injury specialist, but it is not a protected profession. The result is that smarter entrepreneurs without legal knowledge have started a personal injury agency. These personal injury offices offer to recover personal injury damages free of charge, but unfortunately the quality is often lacking. The damage is often not fully recovered and future complaints and aggravation of the injury are also not taken into account.

Despite the fact that various professional associations and quality marks try to sideline personal injury firms, there are still many of these personal injury firms. So they can go about their business until now.

The system in the Netherlands is great for the victim, but also has dangers!

Personal injury lawyer costs in other countries

Other European countries do not have the Dutch system. In most countries you must therefore pay the costs of a personal injury lawyer yourself. Only in Germany and Austria is this slightly different. Here, victims of an accident can receive a small compensation. This compensation never covers the actual bill of the personal injury lawyer.
